Govt considering law in winter session to end triple talaq

After the controversial triple talaq row, the Centre is now planning to implement a rule by bringing a legislation to it in the upcoming Parliamentary Winter Session.

The government, CNN-News18 reported, has formed a ministerial panel to invite suggestions and frame a draft bill ahead of the Winter Session.

Sources in the government say that the call for reforms in the personal law had arisen from the Muslim community itself.

However, it had concluded that "talaq-e-biddat" was a matter of personal law of Muslims that does not breach the Constitution's Article 25 (right to practice one's religion).

"The government wants to implement this on ground and hence there is a need to bring the legislation", a senior government functionary said. In a 3:2 majority verdict, the court held that the practice was unconstitutional and it violates fundamental rights of a woman as it irrevocably ends the marriage without any scope of reconciliation.

Sources said the Centre has noticed that there have been reports of a number of divorces by way of Talaq-e-biddat happening even after the aforesaid judgement by the Supreme Court.

In a recent incident of Talaq-e-biddat, it was noticed that a person in a leading educational institution divorced his wife through WhatsApp and short message service. Either the information on the decision of Supreme Court has not become a common fact or lack of deterrence was not changing the mind set on Talaq-e-biddat.

Many Muslim countries have banned triple talaq, including Pakistan and conservative Saudi Arabia. They felt that the provisions of the Indian Penal Code were sufficient to deal with cases when aggrieved women approached police.

The law allows Muslim men to divorce their wives simply by uttering the word "talaq" three times.
