Menendez jury says it's deadlocked; judge says to keep going

A representative for the court clerk's office and the U.S. Department of Justice did not immediately respond to a request for comment. Robert Menendez, D-N.J., told the judge Monday that the members are deadlocked on whether to convict him - but the judge told them to take the rest of the day off and try again. The judge told the jurors to "clear your heads" and return Tuesday.

If found guilty of all charges, Menendez could face a sentence of up to 20 years in prison. That former juror predicted the panel would end in a hung jury.

Jurors sent Walls a note saying they were not able to reach a unanimous decision on any of the 18 counts prosecutors filed against Menendez and co-defendant Salomon Melgen, the wealthy Florida eye doctor and top Menendez donor.

"Is there any additional guidance and what do we do now?" the foreman asked the judge in his note.

The jury resumed deliberations earlier Monday with an alternative, following the dismissal of Arroyo-Maultsby.

Jurors are instructed before and during the trial not to read reports about the case.

A juror, who was dismissed last week due to a previously scheduled vacation, told reporters on Friday, November 10th, that she had voted for acquitting the senator on all counts.

Lawyers for Menendez and Melgen have told the jury in Newark, New Jersey, that they did nothing wrong and that their actions stemmed from a close, brother-like relationship.

Defense attorneys argued Monday that the excused juror's comments could be a breach of protocol.

Menendez, a Democrat and New Jersey's senior senator, is charged with advocating for Melgen's business interests with top US government officials in exchange for vacations in the Dominican Republic, private jet flights, hotel stays, a vehicle service and about $750,000 in political contributions. They also contend Menendez's meetings with government officials were focused on broad policy issues.
