Senate Obeys Court, Recalls Ndume 8 Months After His Suspension

The Senate in reaction said they will appeal the Federal High Court judgement on Monday.

The Borno APC senator was placed on suspension following the recommendation of the ethics and privileges committee of the Senate headed by Chris Anyanwu which accused him of raising a false alarm capable of tarnishing the image of his colleagues.

The Senate had on Monday filed an appeal against the judgment of the Federal High Court, delivered today, 10th of November, 2017 which declared the suspension of Ndume null, void and of no effect.

"The notice of appeal is ready and would be filed unfailingly by Monday morning". Ali Ndume, who has been on suspension.

"Besides, Senate spokesman, Senator Abdullahi Sabi Aliyu had earlier advised Ndume to withdraw his suit against the senate last September otherwise the upper chamber would contest decisions of the courts to the Supreme Court of Nigeria".

In a twist of events however, a letter dated November 6, written by the Clerk of the Senate, Nelson Ayewoh, and addressed to Ali Ndume, notified him to resume in plenary on Wednesday (tomorrow).

The grounds given by the senate for the application for stay of judgment execution is that the appeal raises good, arguably, triable and recondite issues and grounds of appeal which makes it a proper case for which the execution of the orders of the court as contained in the judgment should have stayed pending determination of the appeal.

Justice Babatunde Quadri had held last Friday that Ndume's suspension was illegal, unlawful and unconstitutional.

Mr. Ndume was suspended for raising a matter that the Senate investigate public allegations of impropriety against the Senate President, Bukola Saraki, and another senator, Dino Melaye.

Saraki and Melaye were cleared of the allegations by a senate probe panel.

"The court has so declared that it was not right and it was illegal".

"That the Plaintiff wrongly joined several causes of action in his Originating Summons".

"The Senate's argument is supported by various and current decisions of the apex court, " he noted.
