US Attorney General Jeff Sessions Sued Over Medical Marijuana

The girl's name is Alexis Bortell and she has a lot of support from her parents and more plaintiffs like Marvin Washington (former National Football League player), who already filed a suit against Jeff Session and the Drug Enforcement Agency.

Alexis Bortell, a 12-year-old forced to relocate with her family to access medical marijuana, is suing U.S. Attorney Jeff Sessions.

Alexis is treated for severe seizures, a condition for which she is given a drop of oil in the morning and another at night right before bed.

The lawsuit was filed in July 2017 in the Southern District of NY where the legal text for the case said that it "stands to benefit tens of millions of Americans who require, but are unable to safely obtain, Cannabis for the treatment of their illnesses, diseases and medical conditions, the successful treatment of which is dependent upon its curative properties."Bortell's lawsuit is not only against Sessions and the Justice Department, but also against the Drug Enforcement Agency". A pediatrician eventually mentioned the out-of-state option: medical marijuana.

But because some states have approved marijuana for medical and other purposes while others haven't, a disparity exists that would keep patients who use cannabis therapy from moving to or traveling in states where the drug is still illegal.

The suit claims that Alexis can not return to her home in Texas to attend college because she would be subject to arrest if she continued to use marijuana to control her seizures. But NBC reports Alexis doesn't want others like her to have to leave their homes just to get the treatment that works for their illnesses.

Although marijuana has been legalized in medical use for some states in the US, this lawsuit wants to achieve a nationwide legalizing.

"She just wants to be like everybody else". And, "Since being on whole-plant medical Cannabis, Alexis has gone more than two years seizure-free". She would have to choose between living a normal life and going to get higher education for a better future.

Michael Hiller, Bortell's lawyer, also criticized what he believed to be an inconsistency in the application of the "irrational" and "unconstitutional" Controlled Substances Act.

The Justice Department has reportedly filed a memorandum of support for a motion to dismiss the case.

He noted, however, that it will be a challenge for government officials to argue that there is no medical benefit to the use of marijuana.

So far, only 29 states have legalised medical marijuana.
