Amazon investigated by advertising watchdog over delivery complaints as Christmas gifts delayed

According to reports in The Sunday Telegraph and the Guardian, Amazon customers have contacted the ASA to complain that the "unlimited one-day delivery" that comes with the Prime service is failing to deliver on time in the run-up to Christmas.

Online retail giant Amazon may be investigated by the Advertising Standards Authority after Prime customers complained the one-day delivery time was not being met.

The spokeswoman said the complaints were being "considered", but added that no official investigation had been opened at this stage.

The service is available as a complimentary 30-day trial and costs £7.99 (which converts to $10.66) every month after.

It also offers this coming Saturday, 23 December, as its final order date for Christmas orders, three days later than the Wednesday offered for non-Prime customers. "We are considering whether to launch an investigation".

The consumer rights group Which? points out that a company missing its delivery date is in breach of contract.

Amazon advises customers to contact customer services if they do not receive a parcel by the estimated delivery date. If in stock it'll be dispatched that same day... Customers are taking to Twitter to voice their displeasure with late deliveries from Amazon Prime in the United States, too.

The main issue appears to be for people who have signed up to Amazon Prime and been promised next day delivery and the item doesn't arrive.

It upheld complaints that the advert in question, a direct mailing sent to existing Amazon customers, did not make sufficiently clear that a paid subscription would automatically start if not cancelled during the free trial and did not state what the cost of the subscription would be.

Amazon UK did not immediately respond to a request for comment.
