Illegal Immigrant Faces Federal Charges in Kate Steinle's Death

Last week, a jury found Garcia-Zarate guilty of felony possession, but not murder or involuntary manslaughter.

Jose Ines Garcia-Zarate, 47, was indicted by a federal grand jury in San Francisco on charges of being a felon in possession of a firearm and ammunition and for being an illegally present alien in possession of a firearm and ammunition, the agency said in a statement.

Federal officials filed a new set of immigration and gun charges against Jose Ines Garcia Zarate, the illegal immigrant found not guilty last week in the murder of Kate Steinle.

Steinle was killed on July 1, 2015 when a gun Zarate was holding discharged, the bullet ricocheting off the ground at a pier frequented by tourists before striking her.

If convicted, he could face up to 10 years in a federal prison, according to the Department of Justice. They intend to seek the dismissal after a sentencing hearing set for December 14.

San Francisco District Attorney George Gascon on Tuesday defended his office's handling of the case.

He added that Garcia-Zarate would ultimately be deported.

President Donald Trump frequently brought up the case past year during his presidential campaign to criticize efforts in the U.S.to combat illegal immigration.

A Department of Justice spokesman said that the federal firearms charges would not amount to double jeopardy against Zarate because they differed legally from the state court charges.

Garcia Zarate had been deported five times before he was arrested a few hours after the shooting.

Steinle's death, which occurred during the presidential campaign, sparked harsh criticism of San Francisco's policies as a sanctuary city.

President Trump also chimed in, tweeting, "A disgraceful verdict in the Kate Steinle case!"
