Australia takes Canada to WTO over wine

Australia has complained at the World Trade Organization about Canada's rules on wine sales, expanding a similar USA complaint against one Canadian region.

Minster Ciobo said he would prefer to have resolved the issue bilaterally, but that "it is appropriate to commence dispute proceedings given the lack of progress".

Mr Ciobo denied the action is connected to Prime Minister Justin Trudeau's snub of other world leaders during talks on a new Trans-Pacific Partnership deal at APEC last November.

"These are unrelated events", the Minister said.

"These measures are impacting on Australia's ability to better access this market". That's an unacceptable outcome.

Vietnam has also voiced concern that the USA has broken rules on dispute settlement while turning down Vietnamese exporters' request for a revocation of the anti-dumping measures, although they are eligible for such a revocation.

"Canada's wine market is worth approximately $7 billion", he was quoted as saying.

The complaint goes on to state: "The Ontario measures appear to operate so as to favour products of Canadian origin and potentially exclude or limit imported products from being displayed and sold".

The move comes amid concerns that Canada is seeking to curb access to its markets in the face of efforts to resuscitate the landmark Trans-Pacific Partnership deal after the US pulled out.

"Wine sales in Canada are controlled by provincial liquor boards. The Nova Scotia wine measures provide reduced product mark-up for local producers and preferences through supplier competitions and price bands". "We respect the Canadian wine industry, but we are seeking a level playing field to ensure we can maximise our opportunities in this key market", said chief executive, Tony Battaglene.

The Winemakers' Federation of Australia has welcomed the move, with bilateral discussions between the two countries having failed to make headway on the issue.

WTO consultations are the first stage in a dispute-settlement action.

The action follows the U.S. launching its own WTO trade dispute settlement action against Canada in January 2017 regarding "Measures Governing the Sale of Wine in Grocery Stores", which Australia joined as a third-party observer.
