US Supreme Court Will Hear Texas' Redistricting Cases

The National Retail Federation welcomed the U.S. Supreme Court's decision today to take up a South Dakota case on whether online sellers can be required to collect sales tax the same as local stores but also urged Congress to address the issue through federal legislation. The Court noted that "specific portions" of the 2011 plans that were found to be discriminatory or unconstitutional "continue unchanged".

The U.S. Supreme Court on Friday agreed to decide whether to let states require online retailers to collect billions of dollars in sales tax, taking up South Dakota's dispute with three e-commerce companies. Both the congressional and legislative map cases are Abbott v. Perez.

State GOP leaders have argued the maps were drawn to favor Republicans, not to disenfranchise minorities. Maryland Republicans are challenging a single Democratic congressional district based on voters' freedom of speech. Folded into the case will be the question of whether nine state House districts illegally harm minority voting rights.

Texas Attorney General Ken Paxton praised the high court's action, calling the lower-court rulings "inexplicable and indefensible" and saying they could produce electoral chaos if allowed to stand in an election year.

In an NPR interview in July, Seliger denied any racial gerrymandering.

None of the affected House districts are in Bexar County, but several are in the Dallas-Fort Worth area. Doggett's district was essentially overloading it with Democrat-leaning minority voters, the judges said.

EBay Inc. spokeswoman Penny Bruce said the company hopes the court will "clarify again that independent small businesses can not be taxed in a state where they do not have facilities, employees or a voice in the local political process".

"We are eager for the chance to present our case before the U.S. Supreme Court", Paxton said in a written statement Friday. Even if the court rules against the maps, he expects the decision will be too late for the districts to get redrawn before the 2018 contest. Texas voters will choose candidates in the March 6 primaries according to the current districts, but the Supreme Court's ruling is not expected until summer, when primary winners will be campaigning in advance of the November general elections. His case was heard by an administrative law judge, and he received a lifetime ban from investment-related work. A ruling in that case is pending.

Those cases - along with a challenge to how Securities and Exchange Commission employees enforce investment protection laws - highlight a batch of grants that will fill much of the court's remaining term, the justices announced Friday.

Beyond the 2018 elections, the case outcome could carry long-term impacts for Texas. "We will again be before the Supreme Court to examine Texas Republicans' stacking of the deck through systemic discrimination against people of color".

For decades under the Voting Rights Act, Texas was a on a list of states needing the federal government's approval of election laws, a safeguard for minority voting rights called preclearance.

"This court must take account of how its own, outdated precedent has played a part in that development, pushing economic activity (and important entry-level jobs) from Main Street to distant tech companies, with a tangible effect on everyday American life".
