Memogate: SC issues arrest warrants for Husain Haqqani

The Supreme Court on Thursday issued arrest warrants for former ambassador of Pakistan to the United States Hussain Haqqani. "Why should we not issue him a notice to appear before the court so that he could face allegations in the Memogate scandal?" "SUch political "warrants" have not been honored overseas in the past, won't work now". On January 3, 2013, Haqqani left Pakistan with the commitment to come back on a four-day notice and the court had allowed him to go overseas.

Questioning authority of the apex court, the former ambassador said: "Nowhere in the world do Supreme Courts issue warrants, that being a function reserved for trial courts".

At the last hearing of the case on February 8, the Supreme Court was assured by the additional attorney general (AAG) that all efforts will be made to bring back Haqqani.

The matter was taken to the Supreme Court by then opposition leader Nawaz Sharif after which Haqqani had resigned as an envoy. Haqqani, who served as Ambassador from 2008 to 2011 in the United States, was removed from office for his alleged role in the issue, the Dawn newspaper reported.

In December a year ago, three people had separately lodged FIRs against Hussain Haqqani in two police stations of Kohat for delivering hate speeches and writing books and articles against the armed forces and the "sovereignty of Pakistan".

Haqqani in a statement yesterday said, "no expectation of justice or fair play from the Pakistani establishment, of which the Supreme Court is an integral part" and described renewal of the Memogate case after a hiatus of six tears as "an attempt to revive propaganda against me in anticipation of my forthcoming book 'Reimagining Pakistan".

Following the article's publication and subsequent media uproar, the PPP also accused Haqqani of "treason and maligning the country's armed forces at the behest of anti-Pakistan elements".

The cases were registered under Sections 120 (b) (hatching a criminal conspiracy) and 121 (a) (waging a war against Pakistan) of the Pakistan Penal Code.

A three-member bench headed by Chief Justice Mian Saqib Nisar conducted proceedings of the Memo commission case during which the apex court passed the order.

The case had reminded the chief justice of Haqqani.

He, however, did not return to the country and breached his commitment with the court.

Haqqani was accused of seeking US  action against Pakistan's military through the so-called memo months after the U.S. raid in Abbottabad in 2011 on Osama Bin Laden compound amid increasing rift between civilian and military leadership.

It sought assistance from the U.S. for the then-Pakistan Peoples Party (PPP) government for "reigning in the military and intelligence agencies".

Haqqani, however, had denied having anything to do with the memo.
