New Jersey enacts its own net neutrality regulations

New Jersey has joined Pennsylvania and 20 other states in suing the federal government over the repeal of net neutrality.

Gov. Phil Murphy (D) signed an executive order prohibiting all internet service providers that do business with the state from blocking, throttling or favouring web content.

During the signing, Murphy stated the repeal was, "arbitrary and risky and will gives outsized power to a few big companies to control the free flow of information". The protections will apply to both government officials and everyday consumers who are customers of these ISPs.

The new mandate is comparable to ones signed recently by New York Governor Andrew Cuomo and Montana Governor Steve Bullock, who also aim to restore the 2015 open Internet rules.

Those in favor of net neutrality say fewer rules creates a "Wild West environment" among powerful companies that sell a service that's become essential to daily life, according to AP reports.

Without net neutrality, ISPs would be allowed to charge customers or businesses for access to "fast lanes", a premium cost for faster speeds.

"Net neutrality helps and protects tech companies like mine".

CEO Jessica Gonzalez said net neutrality "levels the playing field" to protect smaller companies like hers. It can, however, "exercise [its] power as a consumer to make [its] preferences known". But that classification was repealed by the FCC in December. The lawsuit maintains that the FCC's actions were not only "arbitrary and capricious", but also broke federal law. "If the FCC has its way, ISPs will be able to play favorites on the internet ... deciding, essentially, what consumers can do, say and view online". Chiaravalloti praised Murphy for "show [ing] true leadership" and said that New Jersey must "stand behind and support the public's interest rather than the interests of the large corporate Internet service providers".

The order requires that any Internet service provider that contracts with the state can not block legal content, "throttle, impair or degrade" Internet traffic, or engage in paid prioritization.
