Russian Athletes Appeal To Participate In Pyeongchang Game Rejected By Panel

The Ad hoc Division of the Court of Arbitration for Sport (CAS) has dismissed the application filed on 6 February 2018 by 32 Russian athletes against the International Olympic Committee (IOC) (CAS OG 18/02).

But after last week's CAS decision overturning the International Olympic Committee lifetime doping bans for 39 Russian athletes and reinstating Sochi results for 28 of them, Russia filed a CAS appeal that they should be invited to Pyeongchang because they, too, were now deemed "clean".

They are being referred to as OARs (Olympic Athletes from Russia) and aren't wearing the usual Russian colors of white, red and blue.

In suspending the Russian Olympic Committee, the IOC offered individual athletes the chance to come to the 2018 Games, as "Olympic Athletes from Russia", and "via prescribed conditions - a process that was created to balance the IOC's interest in the global fight against doping and the interests of individual athletes from Russia". Andrew Mitchell of Pinsent Masons, the law firm behind Out-Law.com, said there have been a number of recent cases where athletes have raised a legal challenge against doping violations they have been charged with, or associated bans from competition.

The CAS ruling is a heavy blow to Russian medal chances in Pyeongchang.

A team of neutral athletes from Russian Federation has complained of "negative treatment" at the Pyeongchang Olympics by a Canadian team member, eliciting a puzzled Canadian apology on Wednesday and underlining tensions surrounding Russian Federation at these Games.

"The IOC has been working extraordinarily hard to make sure that we protect the clean athletes", she said. Last week, CAS overturned 28 of those athletes suspensions and partially upheld a further 11 of the appeals.

These Russian "OAR" athletes face several restrictions, however.
