Judge drops most serious charges in Penn State case

A judge in Pennsylvania dismissed for a second time on Wednesday charges of involuntary manslaughter against members of a now-closed Penn State fraternity after a pledge died at a bid acceptance ceremony previous year.

The ruling echoes the judge's previous decision in the case to limit the severity of criminal charges against the former frat members.

Piazza family attorney Tom Kline - who had said after court Monday that the video of the pledges lined up and allegedly forced to drink made them look "like prisoners of war" - said in a new statement today that the Piazzas are disappointed the involuntary manslaughter charges were dropped.

"Despite our feelings of gratitude to the court for today's legal ruling, Gary and his family recognize that a young man tragically lost his life and they continue to pray for Mr. Piazza's family during this extremely hard time", Engle said.

Piazza consumed 18 drinks in 82 minutes, then fell down the stairs at the fraternity house.

District Judge Allen Sinclair tossed out almost 300 new or refiled charges including all five involuntary manslaughter charges, along with all reckless endangerment and hazing charges.

Attorney General Josh Shapiro, whose office took over the case upon the request of a new district attorney in January, said their review of the case was continuing.

Other security camera video played during a preliminary hearing last June detailed his harrowing final hours, showing him falling several times and staggering through the fraternity house before disappearing near basement stairs, where police say he plummeted 15 steps and lost consciousness.

This is the second preliminary hearing in front of the same judge for the fraternity brothers.

"We will move forward with our case and the charges that were held for trial today". 26 men are facing various charges in connection with Piazza's death including involuntary manslaughter, hazing, and conspiracy. "My office is committed to seeking justice for Timothy Piazza and his family and holding responsible individuals accountable for their actions".

Piazza fell down the stairs after participating in that alleged alcohol-fueled hazing ritual at the frat house, but brothers didn't call 911 until the morning of February 3, about 12 hours after Piazza's fall, according to a report on the grand jury's investigation. The members were facing a range of charges, including involuntary manslaughter, in the death of frat pledge Tim Piazza a year ago.

According to Dr. Harry Kamerow, Piazza had also consumed a unsafe amount of alcohol, three or four times the legal limit for driving.

The 11 fraternity members have been excused from this hearing.

Engle believes those messages prove that DiBileo did not know how badly Piazza was injured and wanted to get him help.

The next morning, Piazza was found unconscious and carried upstairs. They claim the fraternity members are not to blame for the death of Timothy Piazza.
