SAP Investigation Finds Payments Made To Gupta-related Entities In South Africa

SAP has admitted that, although it did not pay monies to government officials or employees at state-owned entities, it had paid Gupta-linked intermediary companies over R90 million.

It found that payments were made to Gupta-linked companies.

There was no evidence that SAP had direct contact with anyone in the Gupta or Zuma families - rather, the main concern was the Gupta intermediary Santosh Choubey.

This is part of the outcome of global software company SAP's investigation into contracts with the two state-owned enterprises‚ released on Thursday.

Details of the payments to Gupta-related third-parties come after SAP said a year ago it was being probed by the US Department of Justice and the US Securities and Exchange Commission over how it won contracts with South African state businesses Eskom Holdings SOC Ltd. and Transnet SOC Ltd.

SAP had already removed the managing director and chief financial officer in the territory, flying in senior execs to take control of the situation as soon as the scandal hit, and is due to announce a new permanent MD next week.

SAP said a probe by law firm Baker McKenzie found that the German software giant made the payments to third parties as commissions on contracts with Eskom and ports and rail operator Transnet. But three senior SAP executives who were suspended in July a year ago have since resigned after being investigated by the company. No severance was paid to any employee, and SAP said it reserves its rights in respect of these executives. The fourth individual was placed on administrative leave but has since returned to work.

"The investigation has confirmed that even strong compliance systems are vulnerable and therefore require eternal vigilance", SAP board member Adaire Fox-Martin said in a statement.

The company has also strengthened its independent Compliance Committee in the SAP Africa region, and augmented the mandatory annual compliance training that every SAP Africa employee must complete.

SAP said that it has taken a decision to end all sales commissions on public sector deals in countries with poor corruption ratings.

"While we cannot turn back the clock, we can promise to do better".
