A South Africa lobby group says it is going to privately prosecute outspoken South African opposition leader Julius Malema on allegations of corruption and fraud.

"AfriForum's Private Prosecuting Unit was established for the very reason of ensuring that equality before the law is upheld and that the NPA does its work effectively".

The party says a group of individuals from have planned to assassinate Malema fearing that the EFF would defeat the ANC in next year's general elections in the North West province and other provinces in the country. However, on 4 August 2015 the case against Malema was struck from the roll of the Polokwane High Court after one of Malema's co-accused could not attend the hearing due to illness.

The EFF said AfriForum's pursuit was not about the law, but an attempt to "deflect the attention of the EFF from economic emancipation struggles, in particular, land expropriation without compensation". "You have to firstly check your security and make sure that you are...whatever that you're going to do or say will be of importance so we have never, ever contacted them", she said.

Gerry Nel, the prosecutor in the Oscar Pistorius murder case, will be heading Afriforum's case, which relates to a lucrative tender awarded by a provincial department of transport to an engineering company Mr Malema as involved in.

Nel said on Thursday that the case subsequently remained closed and AfriForum would apply to the National Prosecuting Authority for a certificate to privately prosecute Malema.

Nel concluded that his unit was at the mercy of the NPA on whether to prosecute or not. In the Malema case, Nel pointed out that Afriforum CEO Kriel was an original complainant in the matter, in July 2011. This follows after a court order was obtained against Malema in 2017 that forbade him to incite people to occupy land. "With his latest statements, Malema is contravening this court order and therefore is acting in contempt of the court order‚" Kriel alleged.

AfriForum said it would not respond to Malema's tweet.

"We can not understand why this is taking so long", said Kriel. The matter has not been ventilated in court to date. In this contract it is agreed that On-Point's involvement may not even be disclosed to the National Treasury.
