Woman set ablaze by boyfriend can testify against him after her death

Judge Guy Reece on Friday ruled the jury will hear the almost two-hour taped deposition, recorded by Judy Malinowski from her hospital bed before her passing in August 2017, NBC 4 reported.

Judy Malinowski, 33, died in August 2017, two years after being set on fire by her boyfriend Michael Slager outside a gas station near Columbus, Ohio, in June 2015.

Malinowski suffered third and fourth degree burns on about 90% of her body and endured 52 surgeries in wake of the brutal attack.

Earlier this month, State District Judge Brett Loveless dismissed the first-degree felony murder charge against Elexus Groves, who was charged with after police say she and Paul Garcia stole a van, fled a police traffic stop and slammed into Shaunna Arredondo-Boling's vehicle, killing her and her 14-year-old daughter, Shaylee Boling.

Michael Slager was arrested after the attack in 2015 and was later jailed for 11 years for felonious assault.

His defense attorneys argued against allowing the testimony from Malinowski saying prosecutors improperly relied on civil law rather than criminal law to obtain the recording.

"I'm so proud of her and I know one day I'll see her, although my heart will be forever broken without her".

'God please, please help me, ' she said.

Slager asserts that he accidentally set Malinowski on fire while lighting a cigarette, although he had allegedly run up behind her to douse gasoline on her. He could face the death penalty, if convicted.

Malinowski lost both her ears and two fingers in the attack and was abandoned open wounds on her buttocks and back.

In January, Slager attempted to move the trial by asserting that the high-profile status of the case meant jurors could not fairly judge him. He previously was sentenced to 11 years in prison on charges including aggravated arson and felonious assault.
