Harvey Weinstein wants to disclose emails that he says discredit rape accuser

On Friday, Weinstein's lawyers are planning to file a motion to dismiss some of the charges, and they hope to present emails that reportedly show one of the alleged victims was actually a romantic partner.

Mr Weinstein's lawyers say the case should be dismissed in its pre-trial stage.

In order to demonstrate that the relationship was consensual, the lawyers want to submit to the judge in his criminal case a cache of several dozen emails Weinstein allegedly traded with the accuser. And the attorneys say grand jurors should have heard about the exchanges before deciding to indict him this spring.

"They may have stupidly jumped the gun here, laying out their plans", a Manhattan law enforcement official told Deadline today of the proposed dismissal that Weinstein's DE based Bayard P.A. lawyers dropped into some bankruptcy filings late last night.

As accusations against Weinstein mounted, his company Weinstein Co fired him and filed for bankruptcy, and he was expelled from the Academy of Motion Picture Arts and Sciences.

Court papers say she sent the message on February 8, 2017 - almost four years after Weinstein allegedly raped her on March 18, 2013.

A spokesman for Manhattan DA Cyrus Vance Jr. didn't immediately respond to a request for comment.

Among the charges is one count of first-degree rape and another for third-degree rape, both in connection with one alleged encounter on March 18, 2013, at a hotel on Manhattan's East Side. Allegations against Weinstein, first brought to light by The New York Times and The New Yorker magazine, catalyzed the #MeToo movement about calling out sexual misbehavior.

Weinstein has been accused of bullying, harassment, misconduct, and/or rape by over 90 women, including actresses Gwyneth Paltrow, Asia Argento, Rose McGowan, and Salma Hayek. Weinstein, 66, has pleaded not guilty to all of the charges and is free on $1 million bail.

"It is Mr. Weinstein's belief that these e-mails are material and exculpatory and the failure of the district attorney to provide this evidence to the grand jury warrants a dismissal of the indictment".
