Chief Justice John Roberts orders new investigation into Brett Kavanaugh

The national news over the last several weeks has been consumed with the saga of Judge Brett Kavanaugh and his confirmation hearings before the Senate Judiciary Committee, ending with his being seated on the Supreme Court on Tuesday.

"Roberts says he received the ethics complaints beginning September 20th, but did not act on referrals until today", Baier added.

Justice Kavanaugh was confirmed by the Senate on Saturday, in a 50-48 vote that followed strictly partisan lines.

President Trump has praised his US Supreme Court pick. That's when the GOP began accusing Democrats of condoning "mob rule" after raucous demonstrators opposing Brett Kavanaugh's Supreme Court nomination harangued GOP lawmakers at the Capitol last week. Henderson said they all relate to the hearings, not to his conduct as a judge.

This means that the complaints made against him are effectively confidential and can be dismissed without releasing the details of the complaints to the public. Henderson took over from Chief Judge Merrick Garland, who recused himself from the matter. It not clear who filed the others.

But Gillers said the complaints "may be found not to be meritorious in the end".

Progressives fought hard against Kavanaugh's confirmation due to his originalist jurisprudence and because he would replace Justice Anthony Kennedy, often viewed as a "swing" vote in many 5-4 decisions.

The first public word of the complaints came Saturday when D.C. Circuit Judge Karen Henderson acknowledged that complaints about Kavanaugh had been filed. The chief judge of the 9th Circuit asked Roberts to transfer the case for review after The Washington Post reported allegations against Kozinski. The judicial council of that court publicly announced it was closing its investigation because Kozinski had retired, saying that because he "can no longer perform any judicial duties, he does not fall within the scope of persons who can be investigated".
