Federal Judge In Texas Rules Against Affordable Care Act

President Trump applauded the decision on Twitter Friday night, writing that he had "predicted all along" that the Affordable Care Act is unconstitutional. This is a surprising result, and one that is hard to justify.

"The court ... declares the Individual Mandate UNCONSTITUTIONAL", Reed judgment concludes.

In NFIB (2012 Supreme Court Obamacare decision), the Supreme Court held the Individual Mandate was unconstitutional under the Interstate Commerce Clause but could fairly be read as an exercise of Congress's Tax Power because it triggered a tax.

"When House Democrats take the gavel, the House of Representatives will move swiftly to formally intervene in the appeals process to uphold the life-saving protections for people with pre-existing conditions and reject Republicans' effort to destroy the Affordable Care Act", Mrs. Pelosi said.

Lawyers for the Department of Justice had suggested that O'Connor should not rule until after the open enrollment period for the 2019 plan year ends on December 15 in order to avoid disrupting the markets.

White House press secretary Sarah Huckabee Sanders said in a statement that the decision "vindicates President Trump's position that Obamacare is constitutional". Bloomberg has more, with the publication adding that the DOJ tried to argue that the individual mandate, including provisions to keep the premium rates the same among healthy individuals and those with pre-existing conditions, should be struck down, but keep the rest of the law intact.

The lawsuit has been opposed by a coalition of 17 Democratic attorneys general, led by California Attorney General Xavier Becerra, a former congressman.

The district court ruling does not necessarily mean the law is officially null, however.

As part of a tax overhaul a year ago, congressional Republicans pushed through a change in which that ACA penalty will be eliminated, starting in January.

The judge ruled that the law's individual mandate violates the Constitution and therefore the entire ACA violates the Constitution.

Politifact notes that 20 million people gained insurance through the Affordable Care Act.

The case is the most high-profile legal challenge to "Obamacare" under President Donald Trump.

House Republicans managed to pass an Obamacare repeal proposal known as the American Health Care Act (AHCA); however, Senate Republicans failed to pass multiple Obamacare repeal proposals during this congressional term.

Twenty Republican-led states, including Kansas, brought the lawsuit.
