US federal judge rules Obamacare unconstitutional

Rep. Nancy Pelosi, who is expected to become House speaker in January, vowed to fight what she called an "absurd ruling".

Texas Attorney General Ken Paxton, who spearheaded the suit, celebrated the ruling on Twitter with three exclamation points: "BREAKING: Texas Federal judge rules Obamacare unconstitutional!"

California and Democratic officials in 14 states, along with the District of Columbia, won permission to defend ACA in the Fort Worth case when the Trump administration sided with the states seeking to dismantle it.

The president said Friday, Congress must now pass a strong law, which provides great health care and protects pre-existing conditions.

At first glance, Judge Reed O'Connor's decision seemed unusual in that it relied on a provision that the Supreme Court already approved in 2012.

O'Connor said in September that he would rule "as quickly as I can" - and ultimately ruled on the eve of the deadline.

"He could have taken a much more surgical approach and just struck down the individual mandate and kept the rest of the law intact".

"If this very bad ruling is upheld in the higher courts, it will be a disaster for tens of millions of American families, especially for people with pre-existing conditions", Schumer said in a statement.

Former Pesident Barack Obama attempted to calm attempted people who fear they will lose their health insurance by saying the decision didn't immediately strike down the law and that there was a long legal battle ahead. 'The Individual Mandate is essential to and inseverable from the remainder of the ACA'.

The decision is nearly certain to be challenged in the US Supreme Court.

Insurers will also no longer have to cover young adults up to age 26 under their parents' plans; annual and lifetime limits on coverage will again be permitted; and there will be no cap on out-of-pocket costs.

On Friday, O'Connor ruled that after the enactment past year by Trump of a landmark tax bill, the ACA's individual mandate requiring most Americans to obtain health insurance or pay a tax could no longer be considered constitutional. They claimed that when Congress repealed the tax penalty a year ago, it eliminated the U.S. Supreme Court's rationale for finding the ACA constitutional in 2012. The TCJA (2017 tax law) eliminated that tax.

Meanwhile, the White House called on Congress to replace Obamacare with an affordable healthcare system which protects people with pre-existing conditions.

They argued that the mandate remains constitutional and that the rest of the law, in any event, can stand without it.

After repeatedly trying and failing to repeal the Affordable Care Act (ACA) in Congress, Trump and his Republican allies have turned to right-wing activist judges to try to overturn this vital law, alleged Democratic Senator Dick Durbin.

A federal judge late Friday struck down the 2010 health care law, siding with a group of conservative states that argued the law is unconstitutional after Republicans in Congress eliminated a key part of it.

"Now", she added in the statement, "the district court ruling in Republicans' lawsuit seeks to subvert the will of the American people and sow chaos in the final day of HealthCare.gov open enrollment".
