China sentences Canadian man to death for drug smuggling

A Chinese court on Monday sentenced a Canadian national Robert Lloyd Schellenberg to death for his alleged involvement in smuggling drugs amid increasing tensions between Canada and China over the recent arrest of Huawei executive Meng Wanzhou.

Schellenberg's lawyer Zhang Dongshuo told Reuters he will likely appeal the sentence.

Schellenberg was arrested in 2014 and received his initial 15-year sentence last November, months after his trial began in 2016. However, the following month, the High People's Court of Liaoning Province ordered a retrial after prosecutors called for Schellenberg to receive a harsher punishment because of the emergence of new evidence which showed his involvement in an worldwide drug smuggling syndicate.

In his defence at his retrial, Schellenberg, a 36-year-old former oil industry employee, said he was a tourist framed by criminals, rejecting allegations he had smuggled more than 200 kgs of methamphetamine in China, the Hong Kong-based South China Morning Post reported. China has executed foreign drug smugglers before: United Kingdom citizen Akmal Shaikh was put to death in 2009, despite protests from British authorities, for smuggling over four kilograms of heroin.

China has since detained two Canadian nationals, accusing them of endangering national security.

Prosecutors told the court that they "now have evidence that highly suggests Schellenberg was involved in organised worldwide drug crime", China's central television broadcaster said in an online report.

Court retrials are rare, said Donald Clarke, a professor at George Washington University specialising in Chinese law, and even rarer are retrials calling for a harsher sentence. The International Crisis Group, which gives advice on solving conflicts, has adamantly denied that Kovrig did anything to harm China.

"I would suggest the Canadian study the Vienna Convention before making such a comment, so as not to be inaccurate and make oneself a laughing stock", Hua said, in response to a question about Trudeau's remarks. Canadian Prime Minister Justin Trudeau criticized China for "not respecting the principles of diplomatic immunity" in Kovrig's arrest.

China has vehemently protested Meng's arrest in Canada and vowed to retaliate.

Schellenberg was again found guilty of taking part in an worldwide drug-smuggling ring, according to the Wall Street Journal.

Schellenberg's family said they anxious China would use him as a bargaining chip following Meng's arrest.

"You can ask these (critics) which laws the relevant Chinese judicial organs and departments have violated by (ordering a retrial)", foreign ministry spokesman Lu Kang said at a regular press briefing on Friday.

China has executed other foreigners for drug-related crimes.
