Jury to rule on Ed Sheeran copying claim

In a decision made public today, Reuters reports, a judge has rejected the English singer-songwriter's request to dismiss the lawsuit, which alleges that his 2014 song "Thinking Out Loud" lifted from Marvin Gaye's 1973 classic "Let's Get It On".

Lawmaker Louis Stanton has insisted a jury should decide whether or not Sheeran and bosses at Sony/ATV Music Publishing and Atlantic Records should be liable to the estate and heirs of late producer Ed Townsend, who co-wrote Let's Get It On.

According to the BBC, the USA judge went on to asses similarities between the tracks including bass lines, percussion the "aesthetic appeal" to listeners.

There it is, "Thinking out Loud" 've copied without the permission of a variety of elements of the Gaye song, among other things, rhythms, harmonies, background vocals and Tempo.

Sheeran's defence team has argued that "Thinking Out Loud" is different due to its "sombre, melancholic tones, addressing long lasting romantic love" while "Let's Get It On" is more of a "sexual anthem".

According to the BBC, Judge Stanton said the songs had similar percussion and basslines and listeners might consider the song's "aesthetic appeal" to be similar.

The lawsuit states: "The defendants copied the "heart" of "Let's" and repeated it continuously throughout "Thinking".

Stanton is also overseeing a separate $100 million case over the same song, launched in June 2018 by US-based Structured Asset Sales (SAS), which part-owns the copyright for "Let's Get It On".

The 1973 song was written by Gaye and Edward Townsend.

In 2013, the Motown legend's family claimed that Thicke and Williams' chart-topping single Blurred Lines plagiarized Gaye's Got to Give It Up.
