In Wednesday's ruling, the court also set a new precedent, saying that the previous rule to vacate a conviction after a suicide was "outdated and no longer consonant with the circumstances of contemporary life".

Hernandez was found guilty in 2015 of killing player Odin Lloyd. Just two years after being convicted, Hernandez died of suicide in his cell.

Aaron Hernandez's murder conviction has been reinstated.

Hernandez's death came shortly after his acquittal of the double murder of Daniel de Abreu and Safir Furtado.

Under the court's ruling, the Hernandez conviction will stand, with the court record noting that it was neither affirmed nor reversed because the defendant died while the appeal was pending.

The Massachusetts Supreme Judicial Court reinstated former New England Patriots tight end Aaron Hernandez's murder conviction on Wednesday, according to the Associated Press.

During his arguments before the court, Bristol District Attorney Thomas M. Quinn III said, "The practice of wiping out a jury verdict like it never occurred is not fair or equitable".

The murder conviction of Aaron Hernandez, shown in 2012, has been reinstated by the highest court in MA.

"We think the Court departed from its usual standards in coming to this decision and intend to seek reconsideration of that aspect of its decision that applies its newly minted law to Mr. Hernandez's case", he said in a statement."The Court has overlooked an essential point of fairness in applying its new rule to this case".

"The current practice. does not consider the interest of the other parties who have an interest in the outcome, ' Quinn told the Boston Globe at the time".

Lawyer John Thompson, who said he was representing "the spirit of Aaron Hernandez", said this would be unfair as the defendant - a critical part of any case - is dead, and can not provide context or help to attorneys to properly appeal his case.

"What it means is that Lloyd's family might be able to collect from the estate", Bloom said.

John Salvi, who was convicted of killing two abortion clinic workers in Brookline in 1994, had that ruling overturned when he committed suicide in 1996.
