Colorado Net Neutrality Bill Heads To Governor's Desk For Signing

We are pleased to learn that President Trump's administration opposes the Democrats' H.R. 1644 and we hope that the White House statement is indicative of more engagement on the current challenges to maintaining an open internet communications market.

Democrats in the House introduced the legislation last month, after taking control of the House of Representatives at the start of this year.

Last year, under Chairman Ajit Pai, the FCC returned to the light-touch regulatory scheme that enabled the internet to develop and thrive for almost two decades by promoting internet freedom and encouraging network investment.

The reversal of net neutrality rules has been a win for internet service providers (ISPs) such as Comcast Corp, AT&T Inc and Verizon Communications Inc, but was opposed by companies like Facebook Inc, Amazon.com Inc and Alphabet Inc. In addition, the bill would restore the FCC's authority to regulate and oversee broadband networks.

Wednesday's vote marked the latest swing of the pendulum in a lengthy battle in Washington over what sites and services consumers can access when they go online, and which startups and industries might flourish as a result.

U.S. Senate Republican leader Mitch McConnell said on Tuesday a Democratic bid to restore the 2015 net neutrality rules is "dead on arrival in the Senate".

With net neutrality, some Democrats sounded an optimistic note that the House's vote - coupled with sustained public pressure from net neutrality supporters - could shift their fortunes. The OMB said the legislation "would instead return to the heavy-handed regulatory approach of the previous administration and undo the FCC's action that restored the Federal Trade Commission's authority to investigate and take enforcement action against unfair, deceptive, or anti-competitive acts or practices committed by broadband providers". Still, the effort to restore net neutrality could give Democrats political points on consumer protections. Roger Wicker (R-MS) who chairs the powerful Commerce Committee.

Tech companies, advocacy groups and others have asked a federal appellate court to vacate the FCC's repeal order - including the decision to override state laws.
